A Bill to repeal section three-b, article nine-a, chapter eighteen of the code of West Virginia, one thousand nine hundred thirty-one, as amended; and to amend and reenact sections three-a and eight-a of said article, all relating to public school support; and establishing funding levels for the total basic foundation program for fiscal year one thousand nine hundred ninety-four--ninety-five only.

Be it enacted by the Legislature of West Virginia:
That section three-b, article nine-a, chapter eighteen of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be repealed; and that sections three-a and eight-a of said article be amended and reenacted, all to read as follows:
ARTICLE 9A. PUBLIC SCHOOL SUPPORT.

§18-9A-3a. Total state basic foundation program for fiscal year one thousand nine hundred ninety-four--ninety-five only.

(a) Notwithstanding any other provisions of this article to the contrary, the total basic foundation program for the statefor the fiscal year one thousand nine hundred ninety-four--ninety-five shall be the sum of the amounts computed in accordance with this section, less the county's local share:
(1) Allowance for professional educators as determined in accordance with sections four and five-a of this article;
(2) Allowance for service personnel as determined in accordance with sections five and five-a of this article;
(3) Allowance for fixed charges as determined in accordance with the provisions of sections six and six-a of this article;
(4) Allowance for transportation cost in an amount equal to the appropriation for such allowance in the fiscal year one thousand nine hundred ninety-three--ninety-four;
(5) Allowance for administrative cost in accordance with the provisions of sections eight and eight-a of this article;
(6) Allowance for other current expense and substitute employees in an amount equal to the appropriation for such allowance in the fiscal year one thousand nine hundred ninety-three--ninety-four: Provided, That the allocation of such funds for expenditure by faculty senates shall be in accordance with the provisions of section nine of this article;
(7) Allowance to improve instructional programs in an amount equal to the appropriation for such allowance in the fiscal year one thousand nine hundred ninety-three--ninety-four.
§18-9A-8a. Foundation allowance for regional educational service agencies.

For the fiscal year beginning on the first day of July, onethousand nine hundred ninety-one, and for each fiscal year thereafter, the foundation allowance for regional educational service agencies shall be equal to sixty-three one-hundredths percent of the allocation for professional educators as determined in section four of this article:
Provided, That for the fiscal year beginning on the first day of July, one thousand nine hundred ninety-four only, the foundation allowance for regional educational service agencies shall be equal to fifty-five one-hundredths percent of the allocation for professional educators as determined in section four of this article. The allowance shall be distributed to the regional educational service agencies in accordance with rules adopted by the state board. The allowance for regional educational service agencies shall be excluded from the computation of total basic state aid as provided for in section twelve of this article.

FINANCE COMMITTEE AMENDMENT

The Committee on Finance moved to amend the bill on page one, by striking out the title and substituting therefor a new title, to read as follows:
Senate Bill No. 327--A Bill to repeal section three-b, article nine-a, chapter eighteen of the code of West Virginia, one thousand nine hundred thirty-one, as amended; and to amend and reenact sections three-a and eight-a of said article, all relating to public school support; and establishing funding levels for the total basic foundation program for fiscal year one thousand nine hundred ninety-four--ninety-five only.
